Limited liability and indemnity

This page sets out the limits of our liability and your obligations when you use birdspikes.store and fit what you buy from us. It sits alongside our terms and conditions.
What we are responsible for
We are responsible for supplying what you ordered, in the condition described, within the window we state. If we get that wrong, our refunds and returns policy says what happens.
What we are not responsible for
- Loss that was not a foreseeable result of anything we did.
- Damage caused by fitting a product in a way its instructions do not describe, or to a surface it is not intended for.
- Injury arising from work at height. Most of these products go on a roof edge, a parapet or a gutter, and how you get there safely is your decision.
- Business losses: lost profit, lost contracts, lost goodwill or lost data.
- Any consequence of failing to check local rules on protected species, nesting seasons or what may be fixed to a listed or historic building.
What nothing here limits
Liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, and any liability that cannot be excluded under the law of your state.
Your indemnity
If a third party brings a claim against us because of how you used this site or fitted a product against its instructions, you agree to cover our reasonable costs of dealing with it.
